PHOENIX (KSAZ) - "We will now convene this meeting for our special emergency agenda," said a Peoria council member.

That emergency; a major ballot bungle. Dr. Ken Krieger, who wants to represent the Mesquite District on the Peoria City Council was left off the early mail-in ballots not once, but twice.

"I choose not to have this happen to anyone else, I may have been wronged by the government, but I'm going to make it right by the voters," said Dr. Ken Krieger.

The Peoria City Council tried to make it right by ordering a third early-ballot made. This time, hopefully, with Dr. Krieger's name on it. But that's not good enough for the candidate, he's now filed a federal lawsuit to hold a special election, just for his race in November.

"The election as it's proceeding right now is just irretrievably flawed. No one can look at this and say there was a way to un-confuse the voters, to correct the mistakes that have happened so far," said Kory Long.

A new election should be determined by the courts or the legislature; my rights as a candidate for a fair election have been violated, as well as the constitutional rights of the voters and my opponents in the Mesquite District of Peoria, Arizona," said Krieger.

Statement from the Maricopa County Elections Department:

The Primary Election ballot originally sent to voters in the City of Peoria, Mesquite district had an error. The ballot contained an incomplete listing of the candidates for the office of Council member. Once our office received notice of the error we immediately worked to advise voters and bring awareness to the situation and send voters a replacement ballot.

Unfortunately, a mistake was made by the print vendor when reprinting and resending the replacement ballot, and the original incorrect ballot was mailed. We are working closely with the City of Peoria to resolve this as quickly as possible and determine what course of action to take next.

We regret this unfortunate event, and offer our sincere apologies to the candidates in this race and the voters in this district for any confusion and inconvenience.
