WASECA PLOT: Attempted murder charges dropped

WASECA, Minn. (KMSP) -

A judge has dismissed four counts of attempted murder and two counts of attempted damage to property that were leveled against a 17-year-old accused of plotting to attack a Waseca, Minn., school, but prosecutors aren't backing down.

John LaDue remains in custody and is still facing six counts of possession of explosives; however, the judge found that prosecutors did not show sufficient evidence that he planned to actually carry out an attack. Now, prosecutors plan to file an appeal of that decision.

LaDue was arrested in April after police found him in a storage locker with guns, explosives and a journal outlining his plan. Just last month, the police interview with LaDue was released -- and in it, he gave a chilling account of what he hoped to achieve.

During the nearly 5-hour interview, Ladue explicitly denied that the 180-page notebook containing his plans was a reaction to childhood tormenters. Rather, he told officers he believes he may be mentally ill and no one had noticed because he's been trying to hide it.

Ladue is currently staying at a juvenile detention facility in Red Wing, Minn. Psychiatric evaluations are progress, as is the adult certification process that could see him tried in criminal court instead of the juvenile justice system.
