Suspect: Adrian Peterson's son choked to death on fruit snacks

SIOUX FALLS, S.D. (KMSP) -

A South Dakota man charged with killing the 2-year-old son of Minnesota Vikings running back Adrian Peterson last fall says he didn’t do it – that the toddler choked to death on strawberry fruit snacks.

Joseph Patterson, 28, is charged with second-degree murder, manslaughter and aggravated assault in the death of 2-year-old Tyrese Ruffin.

Patterson’s explanation for the boy’s death was presented in court Thursday during a motion hearing. He claims Tyrese choked on a fruit snack while he was in the bathroom. According to the indictment, Patterson is accused of shaking the boy or causing deadly head trauma.

Prosecutors want to submit evidence from previous accusations of child abuse against Patterson, but the defense says the similarities of those cases aren't clear enough to allow for prejudicial testimony.
