Man says he's a victim of Southfield police brutality

SOUTHFIELD, Mich. (WJBK) - A man says he was roughed up by Southfield police and that he has the evidence to prove it.

Twenty-five years ago William Franklin made the decision to turn his life around and he's stayed out of trouble since then. So when he was shot with a Taser by a Southfield police officer, he claimed police brutality - and a jury agreed.

When you look at the Southfield Police Department's dash cam obtained exclusively by Fox 2 you might think the man in handcuffs did everything wrong.

He failed to pull over.

He popped off at the mouth.

And then he popped off some more.

But his lawyer says it's police who were out of line.

"He complied with the police officer's directions and request. There was no reason to shoot him. When he fell to the ground the officer added two more jolts of 1200 volts electricity into him," says Ronald Gold, Franklin's attorney.

Gold says last August Southfield police got a call about a domestic disturbance about the people inside a purple car. Police pursued but William Franklin didn't stop.

"He said he never saw the flashing lights, he didn't think the police car was after him and he knew he had done nothing wrong so he pulled around the corner into his driveway," Gold says. "He did run his mouth because he was upset. It was in his neighborhood; the lights were flashing; he was embarrassed for his neighbors. He knew he had done nothing wrong and he was upset that the police were approaching him like this. He had his hands up in the air and was going to place his hands on the hood of the police vehicle when he was just shot."

Last week this case went to trial in Oakland County. Franklin was charged with resisting, obstructing a police officer and drunk driving. He blew a .10. But he walked on all counts.

Gold says the jury's decision proves people are tired of police playing fast and loose.

"We're tired of police conduct that goes beyond what's necessary, and that's what happened here. This was a situation that could've been handled very easily and diffused very easily and instead the police officer became Rambo," says Gold.

Franklin plans to file a civil suit.
