Libertarian candidate for Minnesota governor arrested at Lake Calhoun, citation dropped

MINNEAPOLIS (KMSP) -

Minneapolis Park Police have dismissed a citation against Libertarian Party gubernatorial candidate Chris Holbrook, determining an officer “misapplied” an ordinance.

Holbrook was at Lake Calhoun on Thursday, gathering signatures to gain ballot access, when he and 3 volunteers were approached by police. An officer cited Holbrook for violation of Park Board Ordinance PB2-15, “use of parks, parkways and waters for financial gain.”

DISMISSAL + APOLOGY

The incident and citation were reviewed by Park Police Chief Jason Ohotto, who determined the officer “erred and misapplied the ordinance.” Chief Ohotto dismissed the citation and directly contacted Holbrook to apologize on behalf of the Minneapolis Park Police Department.

“The Minneapolis Park and Recreation Board and the Park Police Department understands and upholds First Amendment and freedom of speech in the parks,” Park Board spokeswoman Dawn Sommers said in a statement.

“This is exactly why I'm running for governor as a Libertarian,” Holbrook said in a statement. “Police shouldn't be harassing citizens while they're engaged in protected political activity.”

Holbrook’s campaign said he was injured during the arrest and sought medical attention Thursday night. Video of the arrest was posted to the Libertarian Party of Minnesota Facebook page at http://on.fb.me/1kQswzf 

INTERNAL AFFAIRS INVESTIGATION

The involved Park Police officer has been identified as Officer Brian Woodfill. Chief Ohotto has initiated an internal affairs investigation, and any potential discipline will be determined after the investigation is completed.
