Attorney General asks same-sex marriage stay to extend until Friday

WJBK - Michigan Attorney General Bill Schuette is asking the Six Circuit Court of Appeals to extend the temporary stay until Friday, March 28. The office says this will allow time for the attorney general to appeal to the Supreme Court should the Sixth Circuit turn them down and allow same-sex marriages.

As it stands now, the temporary stay will expire on Wednesday, March 26. The Sixth Circuit Court will have the final say.

"I took an oath as Attorney General to protect and defend the Constitution. ... I, as one Attorney General, would encourage the United States Supreme Court to make this decision as soon as possible and resolve it. But, again, this will be up for the courts," said Schuette on Monday, defending his decision to appeal the judge's ruling overturning Michigan's ban on same sex marriage. He also launched his re-election campaign that day.
    
"This is not about politics - this is about dignity and equality for every family. This is about equal protection as Judge Friedman said for our children here in michigan, and so I don't think this is a time for politics," says Mark Schauer, the Democratic candidate for governor.  
Meanwhile, the current governor has only issued a statement saying: "The order has been stayed. We await that court or legal direction on this complex, unusual situation."

"It doesn't help him at all to get into this fight. Republicans are going to vote for him regardless," says Eric Foster, a pollster and president of Foster McCollum and White. He says don't expect to hear much on this issue from Gov. Snyder.

"Right not it's smart for him to stay on the sidelines and not get involved. Schuette, on the other hand, he needs to and probably will continue to be a little more vocal because of the current legal fight, but also in helping rally conservatives to him across the state," says Foster.

Foster says both Republicans and Democrats will try to use this issue to their advantage, so expect gay marriage to be a hot topic in the campaigns leading up to November elections.
