CHARGES: Comedian accused of sexual assault after Mall of America set

Felony criminal sexual assault charges have been filed against a comedian from Hollywood who was accused of aggressively assaulting an employee of Rick Bronson's Comedy Club after his set at the Mall of America.

Adam Richmond has appeared on "Last Comic Standing," "Last Call with Carson Daly," and has performed on stand-up stages across the country, but local prosecutors don't find anything funny in the accusations that emerged from the trip he made to Minnesota last summer.

"What Mr. Richmond doesn't understand is the word 'no,'" Hennepin County Attorney Mike Freeman said. "What men need to understand is a woman has a right to say yes or no, and she made all sorts of efforts to get away."

THE CHARGES

Richmond is now facing one felony count of third-degree attempted criminal sexual conduct and a felony count of fourth-degree criminal sexual conduct. If convicted on both charges, Richmond may face up to 25 years in prison and up to $50,000 in fines.

The trial is set to begin next month, but Richmond hasn't stopped traveling or performing. On Thursday night, he headlined a show in Virginia. Fox 9 News attempted to contact Richmond and his attorney, but neither responded. Both his agent and manager were unaware of the charges until now.

THE INCIDENT

According to the criminal complaint filed in Hennepin County, the 40-year-old comedian spent five days headlining at the Mall of America's comedy club in July, and during that time he repeatedly hit on the victim.

Charging documents state that on the evening of July 28, the employee agreed to let Richmond come to her home for drinks with her roommates, but made it clear that she had no romantic interest or other intentions.

Shortly after 3 a.m. the next morning, Bloomington police responded to an assault in progress on the 11000 block of France Avenue South after dispatchers told police they heard a woman yelling at a man, telling him to stop and to get away.

Upon arrival, police met with the victim, who told them that Richmond had been drinking with her and her roommates -- and that he had continuously made inappropriate comments to her while grabbing at her. Each time, she rebuffed him and punched him away.

Charging documents allege that Richmond became even more aggressive after the woman's roommates went to bed, saying "let's make love" before grabbing her breasts. The victim told police she then punched him several times, told him to leave, went to a different room, and ordered a taxi for him by phone.

The criminal complaint details an escalating series of sexual aggression and violence that began after Richmond followed the victim into the kitchen and pinned her.

The victim told police that she fought back, ultimately kneeing Richmond in the groin and running outside; however, Richmond pursued her and knocked her to the ground, reached up her dress, and touched her genitals over her underwear. The victim kicked him again, ran back inside and called 911.

Prosecutors say while the line was open with emergency operators, Richmond forced the victim to the ground and exposed his erect penis before attempting to force it into the woman's mouth. The victim continued to struggle, and Richmond eventually fled and left in the taxi the victim had called earlier.

Bloomington police found Richmond in his room at the Ramada Hotel and took him into custody. Once his Miranda rights had been read, Richmond said he "was maybe a little aggressive. I tried to kiss her, I might have grabbed her."

At the time of his arrest, Richmond had a blood-alcohol concentration of .17, and he acknowledged that he was drunk and his memory was foggy, but he did admit that he exposed his penis and had wrestled the victim to the ground, thinking he was being flirtations.

"Maybe I was horny; I get excited when I am drunk," Richmond told police during the interview.
