CHICAGO (FOX 32 News) -

A 6-year-old boy caught in the middle of an international custody battle could soon be returning to Illinois.

A federal judge ruled that Jack Redmond, who is currently living with his father in Ireland, should be returned to his mother who lives in Orland Park. But, another state court hearing in February could change all that.

For now, though, his mother is feeling pretty upbeat about being reunited with her son.

"I just can't even put into words how happy I am and relieved and excited and so anxious I can't wait for him to come home," Mary Redmond said.

Mary Redmond would love to have her 6-year-old son Jack home for Christmas.

Her tree is decorated with numerous ornaments that he has made for her, but the angel which is his job to put on top, remains nearby, waiting for him to come home.

A federal judge this week issued an order saying Jack should be brought back from Ireland where he was sent 17 months ago to live with his father.

"This is like the best thing ever to hear," she said. "Basically the plans, we're still trying to work out the details of getting Jack home, we are hoping that everything run smoothly and to get him home as soon as possible."

But the attorney for Jack's father, Derek, plans to file an emergency motion to block that.

"Let's just do status quo right now," David Schaffer, Derek Redmond's attorney said. "Jack is not a football he's not to be going back-and-forth let's get some stability in his life and let's get this finally resolved."

That's because an Irish court awarded custody of Jack to his father and Schaffer says a custody hearing in Cook County in February will likely affirm that.

"And as soon as Jack hit's the ground here he may be going back to Ireland," Schaffer added.

Despite that, Mary remains hopeful.

"I'm confident Jack will be home," she said. "Hopefully soon and not in months and months time, but whatever it takes I just want my baby home."

So while the federal judge's ruling seems to be great news for Mary Redmond and could result in her son coming back to Orland Park, this situation is complicated and a 6-year-old boy is caught in the middle.
