Judge in Milke murder case demands explanation

PHOENIX (AP) - A judge says prosecutors in the case of a former Arizona death row inmate must explain why they didn't quickly disclose important information affecting the availability of a key witness.

Judge Rosa Mroz of Maricopa County Superior Court issued the order in the case of Debra Milke. Milke is awaiting retrial in the 1989 killing of her 4-year-old son.

Mroz says prosecutors didn't tell her right away that federal authorities declined to pursue charges against a former police detective in Milke's case because the statutes of limitations have passed.

County prosecutors got the federal notification in an Aug. 30 letter, but Mroz says she didn't learn of it until County Attorney Bill Montgomery mentioned it during a news conference Friday.

Former detective Armando Saldate plans to refuse to testify.
