Charges filed in Minneapolis crash that killed innocent driver

MINNEAPOLIS (KMSP) -

Charges were filed Wednesday against a St. Paul man accused of leading a state trooper on a chase through downtown Minneapolis before crashing into another car and killing the innocent driver.

Yia Her, 43, is charged with two felony counts of fleeing police in a motor vehicle resulting in injury or death. 

Brody Sotona, a 20-year-old aspiring musician from Spring Valley, Wis., was killed in the crash. His passenger, 24-year-old Connor Macklin of Stillwater, Minn., remains in critical condition at HCMC.

Her had a blood alcohol concentration of 0.16 -- twice the legal limit -- and fled because he was driving on a suspended license, according to charging documents.

Her remains in jail with bail set at $500,000, and he faces a potential sentence of more than 13 years in prison if convicted. If Macklin doesn't survive, the sentence would increase.

Hennepin County Attorney Mike Freeman said the trooper involved in the pursuit will not face charges.

"This officer didn't cause the death of the victim -- Her caused it," Freeman said. "That's why Her is going to do big time (in jail)."
