Montco Same-Sex Marriage Issue Going To Court Next Month

NORRISTOWN, Pa. -

A Pennsylvania court will hear arguments next month on the state's attempt to stop Montgomery County from issuing same-sex marriage licenses.

Gov. Tom Corbett says the county is violating state law, which doesn't recognize same sex marriage.

Last week, the Pennsylvania Department of Health sued the county, calling the issuing of same sex marriage licenses "administrative legal chaos."

But Montgomery County officials say the state law is unconstitutional.

The county's register of wills is defending his right to issue the same-sex marriage licenses by saying, in a legal response filed Monday, that the state has no right to tell the county, or his office, to stop issuing them.

 

The issue goes to court on Sept. 4 in Harrisburg.
