4 charges dropped against Victor Hill; Sheriff facing 28 counts

CLAYTON COUNTY, Ga. -

Clayton County Sheriff Victor Hill was in court Friday, just days before his corruption trial is scheduled to begin.  His attorneys are trying to have evidence in the case thrown out.

Prosecutors have agreed to drop four theft charges against Hill, but the sheriff still faces 28 counts accusing him of theft and corruption.

One of the biggest issues is whether or not the prosecution is attempting to put evidence in that shows him improperly using county funds and county vehicles.

Prosecutors say the campaign funds issue shows how Hill allegedly used county money for his own purposes.

"We contend that this money that he took from the general ledger account, the use of the county purchase card -- all of that were incidents where the defendant had lawful possession of those funds," said prosecutor Layla Zon. "As a sheriff, he was in charge to use those funds for the appropriate purposes. However, as a sheriff, he also took an oath that said,  ‘I shall take nothing other than lawful fees that are owed me.'"

Hill's attorney, Steven Frey, countered, "He is the sheriff 365 days of the year, seven days a week. We believe that all which that is under his control -- the sheriff's vehicle and the automobiles and all the equipment -- is his to use as he sees fit."

Both sides agreed on Friday that Hill's voice can't be on robocalls from his office to county residents during the trial.

Hill's attorneys did get some of what they were asking for: he is still allowed to wear his badge in court, but he's not allowed to bring his firearm or wear his uniform in the courtroom.

The trial is scheduled to get underway with jury selection bright and early on Monday morning.
