DETROIT (WJBK) -

The death of an up-and-coming Detroit musician is under investigation.  Eight Mile and Gratiot was shut down Wednesday night for a shooting classified as officer involved.

Police say an off-duty transit officer parked near a Gulf gas station to help his girlfriend with a flat tire, but started fighting with a man in his early twenties selling CDs.

The transit officer reported a minor altercation with a musician to Detroit Police, who were already on the scene for a different call.  Police left the scene and told the victim he should leave, too.  Three minutes later he was dead.

A gas station attendant, who did not give his name, saw the whole thing.  He said the victim frequented the gas station to sell his records, but he never caused any trouble.

"I know for sure the other kid had no weapon on him, nothing at all," the attendant said.

The events leading up to the shooting are a mystery.  The transit officer told police the musician tried to take his gun, but police question how the victim even knew the officer was armed since the gun should have been legally concealed.

Police sources say the transit officer graduated from the police academy and works for Detroit Transit Corporation policing the People Mover in downtown Detroit.  Unlike police, transit officers have no police power off-duty or out of their jurisdiction.

The transit cop was taken in for questioning, but later released.

The shooting is still under investigation while friends and family wait for answers.
