White Plains officer suspended without pay

Posted: Updated:

A White Plains police officer involved in the fatal shooting of an elderly, ex-marine has been suspended without pay.

Officer Steven Hart was one several officers who responded to the medical alert device of 68-year-old Kenneth Chamberlain and arrived to check on him on November 19, 2011.

Police say when Chamberlain, who was mentally disturbed, refused to let them in his apartment, he armed himself with a knife and hatchet, and then charged when the officers broke down his door.

Officer Hart is accused on using a racial slur when he shouted at Chamberlain but he did not fire the fatal shot that killed him.

John Pappalardo, Hart's attorney, told the The Journal News that Hart is no racist and denies using the slur.
