MINNEAPOLIS (KMSP) -
AT&T can build a 450-foot cell tower near Ely, the Minnesota Court of Appeals ruled Monday.
The decision reverses a Hennepin County judge's ruling that concluded a cell tower would have a "materially adverse effect on the environment."
That decision was in line with an argument from The Friends of the Boundary Waters Wilderness, which filed a lawsuit to block the AT&T tower, saying the tower and flashing lights would be visible from Boundary Waters lakes.
The three-judge Court of Appeals panel decided the district court failed to properly weigh the relative severity of the effects of the proposed tower on sight lines from the BWCA.
