A Ramsey County judge is accusing Aaron Foster of gamesmanship in the wrongful death suit filed by his girlfriend's family over her decades-past death and is upholding the verdict that orders him to pay $6 million to the victim's family.
The FOX 9 Investigators got Barbara Winn's cold-case killing reopened, but a jury found Foster not guilty of criminal charges because much of the physical evidence had gone missing in the 30 years since her death.
Winn's family then filed a wrongful death suit and won $6 million after Foster refused to show up for a default judgement where the judge issued a factual finding of murder.
Foster appealed the case, saying he had never been served with court papers.
On Thursday, the judge ruled that the verdict would stand, which means a lien may be placed on Foster's assets; however, Winn's children believe he is essentially broke.
