Man Killed by Officer, Served As Marine

Published : Tuesday, 03 Nov 2009, 8:41 PM CST

SAINT LOUIS PARK, Minn. - The Hennepin County Sheriff's Office is now investigating an officer-involved shooting in St. Louis Park, involving a former marine. Jason Martin's mother says he survived a stint in Iraq. Dawn Marth told FOX 9, she's not sure what led up to her son's run-in with St. Louis Park Police, but she's waiting for answers.

The St. Louis Park Police say 43 year-old Officer John Herman had just left the station around two-thirty Tuesday morning. Officer Herman was off-duty when he saw a truck moving erratically down Minnetonka Boulevard. Driving his own personal SUV, the officer managed to stop the truck near Salem Avenue. Martin and another man were inside, but police won't say which person was driving the truck. Police say the officer fired his gun at Martin. The Medical Examiner's report shows Martin died of multiple gunshot wounds.

Martin's mother says her 29-year-old son leaves behind a wife and a six-year-old daughter. He had been working in the construction business. A check of Martin's record shows he has been arrested in the past for underage drinking and driving after revocation.

Police say Officer Herman has been on the St. Louis Park Police force for five and a half years. He does not have any blemishes on his record. Officer Herman is on paid administrative leave, pending the outcome of an investigation. The Hennepin County Sheriff's Office is not commenting on the case. The St. Louis Park Police Department cancelled a news conference set for Tuesday afternoon.
